Ameer et al. v. Texana Bank, N.A.

Our office along with attorney Joseph Arabbo filed a collective class action claim on behalf of Mortgage Loan Originators who worked for Texana Bank.  A collective class action claim for minimum wages and overtime pay was brought under the Fair Labor Standards Act (FLSA). The lawsuit alleges that Texana Bank incorrectly classified these employees as exempt under the outside sales persons exemption by paying them commission only, and therefore, incorrectly failed to pay each applicable state’s minimum wages and overtime.  It seeks minimum wage and overtime pay on behalf of these employees who worked there within the past three years. It also seeks liquidated damages in an amount equal to the wages owed.
