Our office filed a collective class action claim on behalf of Managers working at Steak N Shake restaurants in its St. Louis Group Market including all of Missouri. A collective class action claim for overtime pay was brought under the Fair Labor Standards Act (FLSA) and class claim was brought under Missouri’s overtime laws. The lawsuit alleges that these employees were misclassified as overtime exempt. It seeks overtime pay on behalf of employees who worked as Managers within the past three years. It also seeks liquidated damages in an amount equal to the overtime pay owed.

Case settled (along with Clendenen, et al. v. Steak N Shake) for $8.35 million.
