Clendenen, et al. v. Steak N Shake Operations, Inc.

Our office filed a collective class action claim on behalf of Managers working at Steak N Shake restaurants across the country. A collective class action claim for overtime pay was brought under the Fair Labor Standards Act (FLSA) and class claims were also filed under Illinois and Ohio’s overtime laws for Managers in those states. The lawsuit alleges that these employees were misclassified as overtime exempt. It seeks overtime pay on behalf of employees who worked as Managers within the past three years. It also seeks liquidated damages in an amount equal to the overtime pay owed.

Case (along with Drake, et al. v. Steak N Shake) settled for $8.35 million.
