Tenaglia, et al. v. The Federal Savings Bank

United States District Court for the Northern District of Illinois, 1:20-cv-1898 Filed: March 30, 2020

Our office filed a collective class action claim on behalf of employees who perform loan file openings, processing, and closings (a/k/a Loan Quality Analyst, Underwriting Analyst, Closing Analyst) at The Federal Savings Bank’s mortgage offices across the country.  A collective class action claim for overtime pay was brought under the Fair Labor Standards Act (FLSA) for these employees alleging that The Federal Savings Bank misclassified these employees as exempt from overtime pay.  The Plaintiff Tenaglia alleges that this class of employees was not paid overtime for hours worked in excess of forty per workweek.  Federal case law has established that employees performing these types of functions should be paid overtime.

It seeks overtime pay on behalf of these employees within the past three years. It also seeks liquidated damages in an amount equal to the overtime pay owed.
