Our office filed a collective class action claim on behalf of drivers working at any of defendant's locations in seven states who operated vehicles weighing 10,000 lbs. or less and were not designed to transport more than eight persons. A collective class action claim for overtime pay was brought under the Fair Labor Standards Act (FLSA) for all such employees nationwide, and a class action was brought for employees working in Missouri under that state's wage and hour laws. The lawsuit alleges that these employees were misclassified as overtime exempt, and not paid an overtime premium for hours worked in excess of forty per workweek. It seeks overtime pay on behalf of these employees who worked for Defendant within the past three years. It also seeks liquidated damages in an amount equal to the overtime pay owed.
